Terms of Service

1. Who you are contracting with

The ListingBoost website and services (the "Service") are provided by Kinnd Co Pty Ltd, trading as ListingBoost ("we", "us", "our"). By using the Service you ("you") enter into a binding agreement with us on these Terms.

2. Acceptance

By creating an account, accessing, or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age and, where acting for an organisation, that you have authority to bind it.

3. The Service

ListingBoost provides AI-powered tools for short-term rental hosts, hotels, and real estate agents to generate listings, descriptions, social content, and related marketing materials.

4. Acceptable use

You must not, and must not allow others to:

• Use the Service unlawfully, fraudulently, or to send spam.
• Infringe intellectual property or privacy rights of others.
• Interfere with security, probe, scan, scrape, or distribute malware.
• Generate illegal content, deepfakes, hate speech, sexual content involving minors, harassment, or attempt to jailbreak the underlying AI models.
• Reverse engineer, resell, or redistribute the Service.

5. AI outputs and your responsibility

You are responsible for the prompts you submit, the content you input, the outputs you choose to use, and for verifying their accuracy and legal compliance before publishing. You represent that you have all necessary rights to the content you submit. AI outputs may be inaccurate or incomplete and should not be relied on as professional, legal, financial, or regulated advice without independent review. We may filter, refuse, or remove content and suspend accounts that violate these Terms or our Acceptable Use rules.

6. Intellectual property

We retain all right, title, and interest in the Service, including software, documentation, branding, and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. You retain rights to content you submit and grant us a limited licence to host and process it solely to provide the Service.

If you believe content on the Service infringes your rights, contact us at support@listingboost.app with details so we can investigate. Repeat infringers will be terminated.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. You can cancel anytime from your account.

8. Service availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and we disclaim all implied warranties to the fullest extent permitted by law.

9. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete account data after a reasonable export window.

10. Liability

To the extent permitted by law, our aggregate liability for any claim is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where law prohibits it.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and disputes are subject to the courts of that jurisdiction, without prejudice to your mandatory consumer rights.

13. Changes

We may update these Terms from time to time. Material changes will be notified through the Service. Continued use after changes take effect constitutes acceptance.
